Part II: Eligibility Requirements and Releases

The Producer is holding auditions to select participants for a television program. The Producer includes each person attending the Audition who is an employee, contractor or agent of the Producer.

I am applying to audition for selection as a participant in the Program I have read and I understand fully the contents of this application and I agree to all the terms and conditions set out below.

The Nominator makes the following promises

• I am 18 years of age or older.
• I am either an Australian citizen or have been a permanent resident in Australia for at least 2 years.
• I am applying in my personal and private capacity and I represent and warrant that I am not an employee of, or in any way associated with, any news or media outlet, including any web based media outlet, either in Australia or elsewhere.
• Now and during the past 2 years, I have not been an employee, officer, director or agent of the Producer or their associates or affiliates and neither is any member of our immediate families or anyone living at our residential address.

The Audition

My application does not constitute entry into a relationship or association of any kind with the Producer and I agree that I will receive no payment for my participation in the Audition.

During the Audition:

1. I will comply with all reasonable requests and directions given by the Producer and I will fully co-operate with the Producer;
2. I will not interfere with or damage the set or any equipment used for the Audition;
3. I will not interfere with, impede or abuse any other person at the Audition;
4. I will participate in the Audition voluntarily and at my own risk; and
5. I agree that the Producer will not be liable to me for any loss or damage or injury to me or to my property or to my reputation caused or suffered in connection with my attendance at the Audition or my travel to and from the Audition.

I understand that I can discontinue my participation in the Audition at any time. If I discontinue my participation in the Audition or refuse to undertake any activity during the course of the Audition, I agree that I will no longer be an applicant for participation in the Program but the terms and conditions of this application will continue to apply to me.

Selection of Participants

The Producer has no obligation to select me to participate in any stage of the Audition or in the Program at their sole and absolute discretion.

The Producer may disqualify me at any time from participation in any stage of the Audition or the Program without providing any reasons.

If I am selected to participate in the Program then I confirm that I will be available for a maximum of Seven weeks during the filming process to be shot between September – December (actual dates TBC)

If I am selected to participate in the Program, I agree:

1. to undertake any medical examination or psychological test, including screening for drugs, prohibited substances and communicable diseases, at times and places determined by the Producer and to provide all medical and other information requested by any person appointed by the Producer to carry out such examination, test or screening;
2. to sign all documents (including agreements, waivers and releases) required by the Producer including but not limited to a Participant Agreement; and
3. to make myself available at the times and places reasonably required by the Producer to participate in the Program and in any publicity for the Program.

I consent to the Producer making such enquiries as they think fit concerning me and my identity, background or history with the Police or any other authority or organisation.

My Health and Physical Condition

I confirm that I am in good physical and mental health and that I do not know of any medical, psychological or other condition that could affect or prevent my participation in the Audition or the Program.

I assert and warrant that I am not a user of any prohibited drug or substance.

Recording, Rights and Release

I understand that, during the Audition, the Producer may record and reproduce on film, tape, photograph and other media my name, likeness, voice and appearance (“Recording”) and use the Recording (in whole or in part) or show the Recording (in whole or in part) to other persons or companies to decide whether I will be selected to participate in the Program. Regardless of whether I am selected to participate in the Program, I agree that the Producer may use the Recording (in whole or in part) in the Program or any publicity for the Program or similar programs overseas by means of any media in any way at any time throughout the world without further consent from me or any payment to me.

The Producer or its assignees will own the copyright in the Recording and may edit the Recording in any way and may synchronise the audio from the Recording with other visual images and the vision from the Recording with other audio.

I agree that I may not make any application to a court of law which could result in delaying the Audition in any place or at any time or the production, exhibition or exploitation of the Program and that this paragraph is fundamental to my being permitted by the Producers to participate in the Audition and the Program.

Confidentiality

I acknowledge that it is essential to the Producer that all matters concerning the Audition and the Program are kept absolutely confidential. I understand that I may obtain information about the audition process, the production of the Program, publicity and promotion of the Program, the people who have applied to participate in the Audition or appear on the Program and about the business of the Producer that is not generally available to the public. This is all “Confidential Information”.

I promise that, at all times before, during and after the Audition (unless otherwise required by law):

1. I will keep the Confidential Information secret and confidential;
2. I will not use the Confidential Information for any purpose; and
3. I will not disclose the Confidential Information to any other person or allow or make it possible for any other person to see any of the Confidential Information.

In particular, I promise that I will not make any statement or give any interview about the Audition or the Program to any media person or outlet without the prior written consent of the Producer regardless of whether I am selected as participants in the Program.

I also promise that I will not communicate to the public via the internet (eg blogs, personal websites, chatrooms) at any time about my/our participation in the Program.

If I breach any of the promises I have made in this application, I understand that I could cause serious financial and other loss to the Producer and they might take legal action against me to prevent me from breaching these promises or to recover from me any losses suffered.
